Terms of Service

1) Agreement to these Terms

By accessing or using Monkeys Finance (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2) Eligibility

You may use the Service only if you:

• are at least the age of majority where you live (19 in British Columbia), and
• are legally permitted to use your connected exchange and to trade derivatives/futures (if applicable), and
• can form a binding contract.

3) The Service

Monkeys Finance provides tools such as:

• algorithmic signal generation,
• simulated backtests,
• notifications to third-party notification providers, and
• optional automated order placement on supported exchanges (including futures), based on your configuration.

The list of supported exchanges and integrations may change over time.

4) No investment advice

The Service is provided for informational and automation purposes only and does not provide investment, legal, accounting, or tax advice. You are solely responsible for your trading decisions, configurations, and outcomes.

5) Trading risks and important warnings

Trading digital assets—especially futures and leveraged trading—involves substantial risk and may result in significant losses, including the loss of your entire position and/or additional losses depending on your exchange and leverage settings.

Backtests are simulated. Simulated results do not reflect actual trading and have limitations (including assumptions about fees, slippage, liquidity, execution, and market impact). Past or simulated performance is not indicative of future results.

6) Accounts and security

You must provide accurate information and keep your account secure. You are responsible for all activity under your account.

You are responsible for:

• keeping your exchange API keys valid and up to date,
• granting only the permissions you intend to grant,
• reviewing your exchange settings (including leverage) and order parameters, and
• monitoring your exchange account.

7) Exchange API keys and permissions

If you connect an exchange, you authorize the Service to place orders based on your settings.

You acknowledge:

• exchange APIs can fail, be delayed, or behave unexpectedly;
• orders may be rejected, partially filled, filled at unexpected prices, or executed when markets move rapidly; and
• the Service may experience errors or outages.

We may surface certain errors in your history/logs, but not all errors can be detected or displayed. You agree to actively monitor your account and risk exposure.

8) Notifications

Notifications depend on third-party providers and may be delayed, throttled, or not delivered. Do not rely on notifications as your only risk control.

9) Free trial, billing, auto-renewal, and cancellation

• Free trial: 1 month, no credit card required.
• Paid plans: After the trial, paid subscriptions renew automatically unless cancelled.
• Auto-renewal: By subscribing, you authorize recurring charges via Stripe using your selected payment method.
• Cancel anytime: You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period unless stated otherwise at checkout.
• Price changes: We may change pricing with advance notice (e.g., via email and/or in-app notice). Changes apply on your next renewal unless otherwise required by law.
• Taxes: Prices may exclude applicable taxes.

10) Acceptable use and restrictions

You agree not to:

• abuse the free trial (including repeated account creation to obtain multiple trials),
• attempt to bypass access controls or security measures,
• reverse engineer, scrape, or copy the Service or any portion of it,
• use the Service for illegal activity or to violate any exchange rules, laws, or regulations,
• interfere with or disrupt the Service.

If we detect free-trial abuse (including repeated use of the same email to recreate accounts for additional trials), we may suspend or ban accounts.

11) Intellectual property

The Service (including software, designs, text, logos, algorithms, and model outputs) is owned by Monkeys Finance Inc. and its licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business use, subject to these Terms.

12) Suspension and termination

We may suspend or terminate access to the Service at any time if we believe you violated these Terms, created risk to others, or for legal/compliance reasons. You may stop using the Service at any time.

13) Disclaimer of warranties

The Service is provided "as is" and "as available." We do not guarantee uninterrupted operation, error-free performance, or that signals, backtests, or automated execution will meet your expectations.

14) Limitation of liability

To the maximum extent permitted by law:

• Monkeys Finance Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, trading losses, lost data, or business interruption.
• Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. If you have not paid us, the limit is $0.

15) Indemnification

You agree to indemnify and hold Monkeys Finance Inc. harmless from claims arising out of your use of the Service, your exchange activity, your configurations, or your violation of these Terms or applicable laws.

16) Changes to these Terms

We may update these Terms from time to time. If changes are material, we'll provide notice (e.g., email or in-app). Continued use after changes means you accept the updated Terms.

17) Governing law

These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without regard to conflict of law rules. Any disputes will be brought in the courts located in Vancouver, BC, unless required otherwise by law.
